Assault on pregnant woman

Published on 29th November 2007 in News

A man from Old Goole threw his girlfriend's shoes at her when she was 33 weeks pregnant, the town's magistrates heard on Tuesday.

Ty Smart (32), of Derwent Road, admitted a charge of common assault relating to August 11.

Julie Laverack Glanville, for the Crown Prosecution Service, said: "The lady was 33 weeks pregnant when it occurred.

"It was around five minutes before midnight. The complainant was walking down Pasture Road with her partner [Mr Smart]."

CCTV showed her to be carrying her shoes, Mrs Laverack Glanville said, and then to sit down in a doorway.

Mr Smart was seen to walk on, then return to his partner, pick up her shoes and throw them at her, hitting her in the face.

She went to hospital and was treated for a bloody nose and a small bruise. Her unborn child was uninjured.

"There were no long-term effects," Mrs Laverack Glanville said.

"In an interview, Mr Smart admitted throwing the shoes but said he did not intend to hit his girlfriend. He admitted being in drink.

"My understanding is that the two parties are still together."

In Mr Smart's defence, the court heard that the incident was a 'one-off', the child had been delivered safely and the couple were still together.

Magistrates told Mr Smart: "This is a serious case and we take a dim view of this behaviour."

The case was adjourned until December 11 for a standard delivery report to be prepared.
